Terms of Service

These terms govern your use of Barkme, the uptime monitoring service operated by Well Digit. Please read them carefully.

Acceptance
- By creating an account or using Barkme in any way, you agree to these Terms of Service. If you do not agree, do not use the service.
- We may update these terms from time to time. Continued use after an update means you accept the revised terms. We will notify you of material changes by email.

The service
- Barkme monitors URLs and domains you configure and alerts you when they become unavailable or behave unexpectedly.
- We provide the service on an "as is" basis. Monitoring is subject to network conditions, third-party infrastructure, and check intervals you select — we do not guarantee 100% detection of every outage.
- We reserve the right to modify, suspend, or discontinue any part of the service with reasonable notice.

Your account
- You are responsible for maintaining the security of your account credentials. You must notify us immediately of any unauthorised access.
- You must be at least 16 years old to create an account. Accounts are for individuals or legal entities — you may not share your credentials with others outside your team.
- We may suspend or terminate accounts that violate these terms, abuse the service, or are inactive for an extended period.

Acceptable use
- You may only monitor URLs and domains you own, operate, or have explicit permission to monitor.
- You must not use Barkme to probe third-party systems without authorisation, generate abusive traffic, circumvent rate limits, or attempt to reverse-engineer the platform.
- Violation of this section may result in immediate account termination without refund.

Subscriptions and billing
- Paid plans are billed on a recurring basis via PayPal. Prices are shown inclusive of any applicable taxes where required by law.
- You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period — we do not issue pro-rata refunds.
- We reserve the right to change pricing with at least 30 days notice. You may cancel before the new price takes effect.

Intellectual property
- Barkme and its underlying technology are owned by Well Digit. Nothing in these terms transfers any intellectual property rights to you.
- You retain ownership of the data you input (monitor configurations, domain names). You grant us a limited licence to store and process that data solely to provide the service.

Limitation of liability
- To the maximum extent permitted by law, Barkme and Well Digit are not liable for any indirect, incidental, or consequential damages arising from your use of the service, including lost revenue resulting from an undetected outage.
- Our total liability for any claim related to the service is limited to the amount you paid us in the 12 months preceding the claim.
