Terms of Service

Acceptance

• By creating an account or using the Service in any way, you agree to these Terms of Service. If you do not agree, do not use the service.
• We may update these terms from time to time. Continued use after an update means you accept the revised terms. We will notify you of material changes by email.

The service

• Barkme monitors URLs and domains you configure and alerts you when they become unavailable or behave unexpectedly.
• We provide the service on an "as is" basis. Monitoring is subject to network conditions, third-party infrastructure, and check intervals you select - we do not guarantee 100% detection of every outage.
• We reserve the right to modify, suspend, or discontinue any part of the service with reasonable notice.

Your account

• You are responsible for maintaining the security of your account credentials. You must notify us immediately of any unauthorized access.
• You must be at least 16 years old to create an account. Accounts are for individuals or legal entities - you may not share your credentials with others outside your team.
• We may suspend or terminate accounts that violate these terms, abuse the service, or are inactive for more than 12 months..

Acceptable use

• You may only monitor URLs and domains you own, operate, or have explicit permission to monitor.
• You must not use Barkme to probe third-party systems without authorisation, generate abusive traffic, circumvent rate limits, or attempt to reverse-engineer the platform.
• Violation of this section may result in immediate account termination without refund.

Subscriptions and billing

• Paid plans are billed on a recurring basis via Paddle, our merchant of record, and may be subject to Paddle’s own terms and policies - https://www.paddle.com/legal/terms. Prices are shown inclusive of any applicable taxes where required by law.
• You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period - we do not issue pro-rata refunds.
• We reserve the right to change pricing with at least 30 days notice. You may cancel before the new price takes effect.

Intellectual property

• Barkme, including the software, underlying technology, trademarks, documentation, and all related intellectual property rights, is owned by Well Digit. Nothing in these Terms transfers any ownership or intellectual property rights to you.
• Subject to these Terms, Well Digit grants you a limited, non-exclusive, non-transferable, revocable licence (e.g., "revocable in accordance with these Terms") to access and use the Service during your active subscription.
• You retain all ownership rights to the data you submit to the Service, including monitor configurations, domain names, and other Customer Data. You grant Well Digit a limited licence to store, process, and use such data solely for the purpose of providing, maintaining, and improving the Service in accordance with our Privacy Policy.

Limitation of liability

• To the maximum extent permitted by law, Barkme and Well Digit are not liable for any indirect, incidental, or consequential damages arising from your use of the service, including lost revenue resulting from an undetected outage.
• Our total liability for any claim related to the service is limited to the amount you paid us in the 12 months preceding the claim.

Governing Law

• These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of Ukraine.
• The parties agree that the courts of Ukraine shall have jurisdiction over any dispute arising out of or relating to these Terms, except where applicable mandatory law provides otherwise.
• Nothing in these Terms limits any mandatory rights that consumers may have under applicable law.
